A Federal Court Judge has denied a Harley Davidson motion to dismiss Harley bikers’ claims for fraudulent and unfair business practices, violations of Consumers Legal Remedies Act (CLRA), and unjust enrichment. A class action lawsuit may now go forward against Harley Davidson alleging certain Harley motorcycle engines produce severe, and excessive heat causing burn injuries and clothing to catch on fire.

Last week, a federal judge ruled that a class action lawsuit against Harley Davidson could go forward, siding with four bikers who claim their Harley Davidson motorcycles were defectively designed because their engines ran so hot as to pose a constant danger to riders of being burned and were therefore not fit for their intended use.

The complaint alleges that since 1999, Twin Cam 88, 96, 103 and 110 cubic inch engines in Harley motorcycles produce severe, excessive heat causing clothing to catch on fire, burn injuries and the danger of burn injury to riders and passengers as well as overheating causing premature engine wear and in models manufactured after 2006, transmission failure. Although Harley Davidson asked the Eastern District of California court to throw out the claims under state law, the U.S. District Judge sided with the bikers.

Greg Owen, a partner at Los Angeles personal injury attorneys Owen, Patterson & Owen and one of the lawyers representing the plaintiffs in this case, states, “Harley Davidson has known about this problem from the early 2000s and has the technology to fix it, but has chosen to sell tens of thousands of touring bikes here in California without disclosing this known defect. When Harley customers complain to Harley’s dealers after purchase, Harley’s response is that’s normal and it refuses to offer an effective fix to the problem.”

Owen believes the unsafe heat problem is due to Harley selling larger engines that cannot comply with the emission standards of many states, including California.

‘The fix is pretty simple,’ says Owen, “and Harley already has it – manufacture touring bikes with liquid cooled engines instead of air cooled engines. If Harley did that this serious design and safety defect would go away.”

The recent ruling allows the case to move forward, and Harley Davidson will now face Class Action Certification process at the end of the month. image

Amsoil Equipped Motorcycles Shine In Fuel Economy Challenge

Amsoil

AMSOIL synthetic lubricants figured prominently in the Vetter Fuel Economy Challenge held May 13 in northern California, where a diesel-powered motorcycle using Amsoil products won by achieving 128.24 mpg. Many of the other bikes also relied on Amsoil products to help achieve results nearly as impressive.

Winning driver Fred Hayes of Hayes Diversified Technologies (Hayes-DT) completed the challenge riding the company’s MD670 F2 diesel-powered motorcycle (pictured above). Hayes bested the next closest competitor by over 18mpg using biodiesel fuel, a lightweight motorcycle design (370 pounds dry) and Amsoil synthetic lubricants throughout.

  • Engine and Transmission – Series 3000 5W-30 Synthetic Heavy Duty Diesel Oil
  • Cooling System – Antifreeze and Engine Coolant, Dominator© Coolant Boost
  • Chassis – Series 2000 Synthetic Racing Grease
  • Chain – MP Heavy Duty Metal Protector
  • Forks – Shock Therapy© Suspension Fluid #10 Medium
  • Fuel – Diesel Concentrate

Competitors completed a 133.5-mile course designed to provide real-world, challenging conditions. The trip, beginning and ending in Carmel, Calif.,

included mountainous terrain cresting a 2,500-foot pass, while the return ride along the famous El Camino Real subjected riders to 30 mph headwinds that tested the limits of each motorcycle’s fuel efficiency. Held at various places throughout the country, the Vetter Fuel Economy Challenge dates to 1980 and aims to encourage development of motorcycle technologies that improve fuel economy while remaining viable for everyday drivers.

The winner must consume the least amount of fuel measured in dollars and cents while meeting all prescribed conditions. Hayes used $4.53 in biodiesel, essentially one gallon, to travel the entire 133.5 miles in challenging conditions, highlighting the bike’s impressive technology and the effectiveness of AMSOIL products. Hayes said his bike showed measurable improvements running Series 3000 5W-30 Synthetic Heavy Duty Diesel Oil and Diesel Concentrate, including easier shifting from the transmission. Competitors had to remain ahead of trailing official at all times to prevent them from padding fuel economy statistics by driving slowly. Two bikes were disqualified for doing so.

AMSOIL-sponsored Hayes-DT focuses on developing the world’s most cutting-edge, heavy-fuel-powered, light tactical vehicles and small engines for military use.

In fact, key Hayes-DT corporate personnel have served in modern military conflicts deployed on Hayes-DT military motorcycles. The bikes receive the most use from the Combat Military Police for rout recognizance and convoy control.

Hayes-DT Street Fighter bike

The Hayes-DT Street Fighter bike achieved 90.82 mpg running biodiesel and AMSOIL lubricants throughout

A second Hayes-DT bike, the Street Fighter, was disqualified after a battery problem caused it to miss the official start. Following repairs, driver Josh Chen rallied to complete the course anyway, achieving 90.82 mpg, which would have been good enough for third place. The Street Fighter used the same lineup of AMSOIL products as the MD670 F2. Although neither motorcycle is available to the general public yet, Hayes-DT is currently working on EPA and EU emissions certification. Until then, competitions like the Vetter Fuel Economy Challenger allow Hayes-DT to showcase the advanced technologies of their bikes and the performance benefits of AMSOIL synthetic lubricants and additives.

EBR 1190 Ready To Race in Ohio

July 07, 2011

A pipe dream is about to become a reality this weekend in Ohio.  The AMSOIL sponsored Erik Buell Racing (EBR) 1190 RS has been in production for the past several months, with more than 30 bikes already in the hands of customers.  At the AMA Pro Road Racing event held in Lexington, Ohio this weekend, the EBR 1190 will race for the first time.

The new bike will be replace the Buell 1125 that top rider Geoff May has been riding so far this season in the American Superbike class.  The new bike will bring more horsepower, better aerodynamics and smoother handling to the Mid-Ohio Raceway.  For company founder Erik Buell, it’s the next step in Eric Buell Racingrebuilding a brand.

Eric Buell Racing

AMSOIL Racing: Erik, we know you’re excited.  How is Geoff doing?

Erik Buell:  Extremely excited, but cautious. We know we are just getting started racing the EBR 1190RS, but we all know what a huge amount of effort it took to get here. The whole EBR team, including suppliers and sponsors like AMSOIL, has been working so hard to get us to this point that it will be a very rewarding moment to see all their efforts on track at last.

AR: So you guys got approved by the AMA.  Not an easy process, right?

EB: This was a complex process, unlike in the past. We had to prove we had produced a certain number of fully street legal 1190RS models that met all EPA/DOT regulations. No special allowances for modifications, or using legality in some other country as a means to qualify. Also we had to supply a complete set of critical parts, all detailed drawings for the parts with tolerances, as well as parts manuals, owner’s manuals, etc. Everything to make sure they can validate that we are racing the street bike with only allowable modifications, nothing custom just for our team.

AR: The bike has a little more get-up-and-go over the 1125?

EB: The bikes will have a bit more than the 1125RR race bikes had,  but they have not been refined or tweaked yet. Basically stock motors, with a base gasket removed to increase compression, and a race muffler and race ECM. So about 180 RWHP.

AR: Is there anything also about the bike we can add?

EB: The bikes started as stock 1190RS models that the race department received about two weeks ago.  And the 1190RS is completely new from front to rear from the old 1125. The radically different bodywork is the visual cue, but from front axle to rear, it is a new bike. So the team has a lot to learn, but are very excited about the potential.

AR: Good luck this weekend.

EB:  Thank you and many thanks to everyone at AMSOIL for their help in getting this bike on the race track.

This is MY TEAM TO WATCH THIS YEAR!  It’s great to see Buell still going.

This past offseason, Team AMSOIL road racing rider Larry Pegram made a major move from his previous Ducati bike to the BMW S 1000 RR. After months of testing, Pegram unleashed the new bike at the opening round of the 2011 AMA Pro Road Racing American Superbike Series at Daytona International Raceway in Daytona, Fla. Although he placed ninth off the pole and fell further behind after a first-lap crash, Pegram remounted and worked his way up to seventh. On Saturday, he pushed his new bike one spot better, finishing sixth.

“Daytona didn’t go exactly how I had hoped,” said Pegram. “But the BMW S 1000 RR is a fast bike and I feel like we’ve really got it dialed in now. We’re looking forward to the next race and I think this is going to be a great season.”

Team AMSOIL/EBR rider Geoff May climbed aboard his proven EBR 1125 model to finish 20th and 12th respectively. The team will unveil the new EBR 1190R bike later this spring.

“There are always a few gremlins at the first race of the year, but we know the 1190 is coming soon and Geoff did a great job despite the lower horsepower,” said team owner and legendary bike builder Erik Buell. “The AMSOIL bike was a big hit in Daytona, and everyone was excited to see us back in the Superbike class.”

The AMA Pro Road Racing season resumes May 13-15 at Infineon Raceway in Sonoma, Calif.
